These provisions regulate the use of the Internet Portal service www.lifesurfing.eu (hereinafter, the “Portal”) that SOCIEDAD ARAGONESA DE GESTIÓN AGROAMBIENTAL, S.A.U. (hereinafter, “SARGA”) makes available to Internet users, in the exercise of their obligations within the LIFE SURFING Project.

In compliance with the provisions of article 10 of Law 34/2002, of July 11, on Information Services and Electronic Commerce (LSSI-CE), SARGA informs you of your identification data:

The simple access, navigation and use of the Portal attributes the condition of user of the same (hereinafter, the “User“) and implies acceptance of the Legal Advice in force and accessible at all times on the Portal.

The User must carefully read this Legal Advice on each of the occasions in which he intends to use the Portal, since it and its conditions of use may be modified.

Some Portal services accessible to Internet users may be subject to specific conditions, regulations and instructions that, where appropriate, replace, complete and/or modify this Legal Advice and that must be accepted by the User before the provision begins. of the corresponding service.

The information contained and accessible through this Portal is provided by SARGA in order to provide general guidelines and offer the user information of general interest.

  • Object

The purpose of this website is to carry out the dissemination of the actions carried out within the framework of the LifeSurfing Project, highlighting the implementation of the tests in the field and the monitoring and analysis of the results obtained.

As part of the dissemination work, SARGA is entrusted with the management of this website www.lifesurfing.eu where the user is allowed, through a contact form, to subscribe to an informative bulletin of the actions carried out in said project, as well as making inquiries about it.

Through this Legal Advice it is intended to regulate the access and use and, in general, the relationship between this Portal accessible at the Internet address www.lifesurfing.eu and the users of the website.

  • Access and use of the Portal

General access and navigation through the Portal does not entail prior registration, except for those functionalities and/or services that require it, in which case it will be necessary to provide certain information through the forms provided for this purpose.

Access to the Web Portal is carried out freely and free of charge by the user.

The nature of the contents of the Portal and the services provided through it are aimed primarily at users over 18 years of age, although it is not restricted to users under that age. Thus, the contents will be suitable for all ages. In cases where the processing of personal data is necessary, the measures indicated in the Privacy Policy will be adopted.

The User undertakes to use the Contents of the website in accordance with the Law and this Legal Advice, as well as with the other conditions, regulations and instructions that may be applicable.

The User, in accordance with current legislation, must refrain from:

  1. a) Reproduce, copy, distribute, make available, publicly communicate, transform or modify the contents except in cases authorized by law or expressly consented to by SARGA or by whoever owns the exploitation rights as the case may be.
  2. b) Extract and/or reuse all or a substantial part of the contents, as well as the databases that SARGA makes available to Users.

SARGA reserves the right to modify, suspend, cancel or restrict the content of the Portal, the links or the information obtained through it, without prior advice.

It is prohibited to transmit or send through the Portal any illegal or illicit content, computer viruses, or messages that, in general, affect or violate the rights of SARGA or third parties.

When the use of the password is necessary, it is personal and non-transferable, and transfer, even temporary, to third parties is not permitted. In this sense, the user undertakes to make diligent use and to keep it secret, assuming all responsibility for the consequences of its disclosure to third parties.

In the event that the user knows or suspects the use of his password by third parties, he must inform SARGA of such circumstance as soon as possible.

  • Intellectual Property

All intellectual property rights of the website www.lifesurfing.eu,  as well as all the elements included in it, belong to the partners of the Life Surfing project. Each Entity is the owner or has obtained the corresponding license on the exploitation rights in terms of intellectual, industrial and image property on the contents available through it, among others by way of example and not exhaustive, the texts, graphic designs, drawings, codes, software, photographs, videos, sounds, databases, indexes, images, trademarks, logos, expressions and information and, in general, any other creation protected by national regulations and international treaties on intellectual and industrial property (in hereinafter, jointly, the Contents).

The user must respect the intellectual and industrial property rights of this website, being authorized, solely and exclusively, to view, print and store the elements included in it for their personal use for informational purposes. In this sense, its use for commercial purposes, as well as its modification, alteration or decompilation, is strictly prohibited.

SARGA does not grant any license or authorization of use of any kind on its intellectual and industrial property rights or on any other property or right related to the website and its contents.

 

The use of these Life Surfing brands and the project logo can only be carried out within the framework of the project’s actions and requires the express authorization of SARGA. Unauthorized use of the trademark may be subject to legal proceedings to the fullest extent possible provided by law.

  • Responsibility

Access to the Portal does not imply an obligation on the part of SARGA to check the veracity, accuracy, adequacy, suitability, exhaustiveness and timeliness of the content provided through it.

The User assumes the responsibility and will leave SARGA harmless with respect to any communication sent, personally or on his behalf, reaching said responsibility without any restriction the accuracy, legality, originality and ownership of the same.

SARGA has adopted reasonable policies in relation to the security of the Portal, although it does not assume any responsibility for the damage that may be caused to the Users’ equipment by possible computer viruses contracted by the User due to browsing the Portal, or by any other damage derived from that navigation.

SARGA does not offer any guarantee in relation to the continuity or absence of errors in any of the content accessible through the Portal, in addition to not guaranteeing the correction of any defect or the absence of viruses and other harmful components in this Portal or in the server that supplies it.

Consequently, the services provided through the Portal may be suspended, cancelled or inaccessible, prior to or simultaneously with the provision of the Portal service.

  • Links to third-party web content

The access service to the Portal includes link devices that allow the User to access other pages and Internet Portals, unrelated to SARGA. In these cases, SARGA does not control nor is it responsible for any of said sites or their content, since it acts as a provider of intermediation services in accordance with article 17 of Law 34/2002, of July 12, on Services of the Information Society and Electronic Commerce (“LSSI”) being solely responsible for the content and services provided in the links to the extent that it has effective knowledge of the illegality and has not deactivated the link with due diligence.

SARGA is not responsible for external websites that can be accessed through links (“links”) or any content made available by third parties. Any use of a link or access to a third-party website is made at the will and exclusive risk of the User. SARGA does not recommend or guarantee any information obtained by or through a link, nor is it responsible for any loss, claim or damage arising from the use or misuse of a link, or from the information obtained through it, including other links or websites, interruption in service or access, or attempt to use or misuse a link, both when accessing the Portal, and when accessing information from other websites from it. The establishment of any type of link from the Portal to a third-party website will in no case entail the existence of a relationship, collaboration or dependency between SARGA and the owner of the third-party website.

In the event that SARGA has effective knowledge that the activity or information to which it refers from said links is illegal, constitutes a crime or may harm property or rights of a third party, it will act with the necessary diligence to suppress or disable the link accordingly as soon as possible. Likewise, if the User had effective knowledge of the illegality of activities carried out through these third-party web pages, they must immediately notify SARGA so that the access link to it can be disabled.

  • Privacy Policy

The processing of personal data that can be carried out through the Portal will be governed by the provisions of the Privacy Policy, accessible at all times from the Portal.

 

  • Cookie Policy

The use of data storage and retrieval devices, also known as cookies or similar technologies through the Portal, will be governed by the provisions of the Cookies Policy, a document accessible at all times from the Portal.

 

  • Jurisdiction

The relationships established between SARGA and the User will be governed by the provisions of current Spanish regulations. SARGA and the User, expressly waiving any other jurisdiction that may correspond to them, will submit any controversies and/or litigation to the knowledge of the Courts and Tribunals of the city of Zaragoza.
